1993 Mumbai blasts: HC grants conditional parole to convict Rubina Memon

Mumbai, Feb 7 (Reporter) The Bombay High Court on Wednesday permitted 1993 Mumbai serial bomb blasts convict Rubina Memon to walk out of prison for six days from February 14 to Feb 20 to attend her son's marriage. However, it imposed a condition that during this period she will be escorted by a police team. A bench of Justices Ajay Gadkari and Shyam Chandak said in its order that she will be escorted by a team of police personnel in plain clothes at the expense of the state. The order was passed during the hearing of a petition filed by Memon, who is the sister-in-law of Tiger Memon, believed to be living in Pakistan and one of the prime conspirators of the serial blasts that rocked the city in March 1993, claiming 257 lives and injuring more than 700 others. Rubina's husband, Suleman Memon, was acquitted in this blasts case due to lack of evidence. Advocate Farhana Shah, representing Memon, had argued before the court that it was a plea for parole that had been rejected by DIG (prisons) Jalinder Supekar. Adv Shah stressed that Memon is a woman who surrendered when she was named in the blasts case and has been on bail many times. "She has served 16 years of imprisonment and been granted parole earlier when her daughter was getting married, now her son is getting married on February 17," the lawyer submitted. Rubina has stated in her plea that being a mother, it is her dream to be part of every function in her son’s marriage, and her family members cannot be punished because of her conviction in the case. During the last hearing, the bench had asked if Memon would attend her son's marriage under police escort. At that time, Adv Shah had replied, "It will be better without an escort, but yes, during the earlier marriage, she had gone in police escort." She pointed out that Rubina has been behind bars for last 16 years, and the expenses of a police team are quite high, which would be difficult for her to bear. Rubina is currently lodged at the women's wing of the Yerawada Central Prison and was granted a six-day parole leave from prison in 2021 by the High Court for her daughter's wedding. In last 16 years, though, Rubina had been granted bail twice as an undertrial prisoner and had surrendered every time, added Adv Shah. Since 2007, when the special court under the special terror act found her guilty of being part of the conspiracy, she has not been granted leave from prison by the authorities and has had to approach the High Court...////...
