Anna Univ sexual assault : Madras HC initiates suo motu proceedings, slams Police over FIR leak

Chennai, Dec 27 (Reporter) Taking suo motu cognisance over the alleged sexual assault on a girl student at the prestigious Anna University campus in the city, the Madras High Court on Friday came down heavily on the police on the leakage of the First Information Report (FIR) that had purportedly contained the name of the victim. A vacation Bench of Justices SM Subramaniam and V Lakshminarayan, after taking suo motu cognisance earlier in the day, directed the Tamil Nadu government to submit a report on the incident and its probe by afternoon. The bench initiated the suo motu proceedings following a letter written to the Court by an advocate R Varalakshmi raising concerns on the law and order in the State and the safety of students in the city. When the matter was taken up in the afternoon, the Court came down heavily on the Chennai Police for leaking the identity details of the sexual assault victim. "How the FIR of the case was leaked by the police...and who is responsible for the victim's family and what they are going through," it asked. Observing that such lapse will dissuade others from approaching the police, the Judges said parents of all students will be afraid now to approach the police. "We are concerned about that too and we want to request all students to come forward and tell us if they know anything more," it said. "You can upload the FIR but you are supposed to redact the identity details. You give us an answer. The damage caused to the victim and her family can't be taken back by you", the Court noted, squarely blaming the police for the leakage, though it was submitted by the Government that it was not leaked by the police. "Tell us by tomorrow morning," the Bench said and adjourned the hearing to Saturday with a direction to submit a detailed report on security arrangements made at the University campus for the safety of the students. The Court was hearing a batch of petitions seeking directions related to the investigation of the case. One of the petitioners is advocate Jayaprakash, who is also a member of the Opposition AIADMK. While demanding a CBI probe, the petitioners also said till then a Special Investigation Team (SIT) headed by a Judge should be formed to probe the incident and it should be monitored by the Court. Soon after the incident came to light, police, acting on a complaint from the victim, arrested a roadside biriyani vendor, Gnanasekaran (37), who, according to police also confessed to committing the offence. According to the complaint, the incident occurred on December 23 and the victim approached the police and also lodged a complaint with the University’s Internal Complaints Committee (ICC) for prevention of sexual harassment. During the hearing of petitions this afternoon, the Court questioned how the Chennai City Police Commissioner of Police A Arun could claim that only one accused was involved in the case. The Court also questioned as to how he could come to a conclusion that the arrested person was the real culprit when the investigation is still under preliminary stage. "How did the Commissioner hold a press conference and make a casual statement that only one accused is involved? Where are your service rules and what do they say about holding press conferences?," it asked. It also asked about the allegations of custodial torture against the accused. "Why did the accused have bandages on his hands and legs?," to which the State government said the accused fell down while trying to escape after his arrest, leading to the injuries. The Bench also sought to know about the lapses on part of the Anna University? Something happened inside your campus..even the police required your permission to enter your campus but a miscreant was allowed to roam freely in your campus." According to reports, the arrested accused, who was facing several cases of crime, has been moving freely in the campus for several years and that police had failed to monitor him. The Court also rejected the contention that girls should not to meet of speak to boys as they have the liberty and freedom to fall in love and adjourned the matter to tomorrow seeking a report from the police...////...
