Bombay HC disposes contempt plea against BMC on potholes

Mumbai, Oct 8 (Reporter) The Bombay High Court on Tuesday disposed of the contempt petition alleging non-compliance of the HC orders in 2018 by the Bombay Municipal Corporation (BMC) to repair potholes along all arterial roads in Mumbai. While disposing of the plea, a Division Bench of Chief Justice Devendra Kumar Upadhyaya and Justice Amit Borkar in its order said that court found that authorities had made efforts for compliance with the 2018 directions, and therefore, were not in contempt of the said orders. The order was passed during the hearing of the plea moved by a city based lawyer Ruju Thakker alleging non-compliance of Court's order to maintain good road conditions by the BMC and other authorities. However, considering the “public welfare and importance”, the court revived the suo motu Public Interest Litigation (PIL) in which the court passed directions in 2018 and sought detailed replies from the civic authorities. The court said it was difficult for it to keep issuing directions in the contempt plea, and hence it was reviving the PIL. The court adjourned the plea till December 5 while observing that Respondents are directed to take immediate corrective action and ensure full compliance with the directions of this court of 2018...////...
