Kolkata, Oct 15 (Reporter) The Calcutta High Court on Tuesday set aside Kolkata Police Commissioner Manoj Kumar Verma's Promulgation Order under Section 163 of Bharatiya Nagarik Surahkha Sanhita (BNSS) banning assembly of persons more than five at the Dorina Crossing and Esplanade, paving way for the doctors to organise "Droho Carnival", court sources said.
The Order of the single bench of Calcutta high court was welcomed by the doctors and their relatives at the venue of "Droho Carnival" with blowing conch shells and beating of drums by the people.
Immediately after the court order, police personnel began to unchain the iron barricades put up around the Dorina Crossing and Rani Rashmoni Avenue allowing the Droha Carnival participants to come in.
The Single judge bench Justice Ravi Krishan Kapur during hearing of the arguments opined that the promulgation Order under section 163 BNSS was in consistent and allowed the medics to join the Droho Carnival.
The sitting of the single judge bench was ordered by Calcutta High Court Chief Justice after the Joint Platform of Doctors last night emailed him requesting for an urgent hearing following the Kolkata Police Commissioner notification banning the assembly of the doctors and their relatives at the proposed Droho Carnival.
For the Doctors Forum senior advocate Bikash Ranjan Bhattacharya told reporters that the court rejected the state government's appeal not to grant stay on the Order.
Kolkata Police Commissioner Manoj Kumar Verma under his magisterial power on Monday night imposed prohibitory order under Section 163 of Bharatiya Nagarik Surahkha Sanhita (BNNS) banning assembly of persons more than five at the Dorina Crossing and Esplanade.
The Police order is to ensure the West Bengal government proposed Immersion Carnival ( Durga Idols immersion) through the Red Road. This was an annual programme of immersion after the Mamata Banerjee government came to power.
"It has come to knowledge that some individuals and organisations will hold a protest styled as Droho Carnival on Rani RashMoni Avenue or its vicinity which is likely to disturb the Immersion carnival on Red Road and likely to cause large scale disturbance of public tranquility and breach of Peace," the notification said.
The immersion carnival starts around 4 PM where the Chief Minister presides over the carnival.
