HC allows Rahul’s plea on evidence in defamation case

Mumbai, July 12 (Reporter) The Bombay High Court on Friday allowed a plea by Congress leader Rahul Gandhi seeking to quash a directive of the Bhiwandi magistrate court that allowed a Rashtriya Swayamsevak Sangh (RSS) functionary to “belatedly” present certain documents in a criminal defamation complaint. “The impugned order is quashed and set aside. Magistrate court is directed to go ahead with trial in accordance with the law and parties are expected to cooperate to dispose of the matter expeditiously,” the High Court held, noting that it had not gone into the merits of the matter. The case pertains to a defamation suit filed by a member of the Bharatiya Janata Party (BJP) over Gandhi’s statement of calling Prime Minister Narendra Modi, ‘Commander In Thief’. The complaint was filed by Mahesh Shrishrimal (43), member of the BJP Maharashtra State Committee, on September 20, 2018. It said, “In relation to the Rafale Aircraft deal, while addressing a public rally at Jaipur then at Amethi, Gandhi defamed Prime Minister Narendra Modi and BJP party members with the remark ‘chowkidar chor hai’ (guard is a thief)... these derogatory remarks tarnished the image of PM at the national and international level. The said remarks and related news were broadcast on various news channels, newspapers and social media causing serious defamation...////...
