Bengaluru, Nov 15 (Reporter) The Karnataka High Court has granted an interim stay on the investigation against BJP MP Tejasvi Surya in connection with his social media post regarding a farmer's suicide in Haveri district. Justice M Nagaprasanna on Thursday ruled that the post did not prima facie incite enmity between groups, halting further proceedings until December 4, when the case will be heard again. Surya had filed a petition to quash the FIR registered by Haveri police, following his post on X. In the post, Surya had linked the farmer’s suicide to the seizure of his land by the Waqf Board, attributing it to the policies of Karnataka Chief Minister Siddaramaiah and Minister BZ Zameer Ahmed Khan. However, after police clarified that the farmer had died two years ago due to financial distress, Surya deleted the tweet. Senior Advocate Aruna Shyam, appearing for Surya on Thursday, argued that the post was based on a news report and did not incite communal or social tensions. Shyam also referenced a media interview with the farmer’s father, which she claimed and supported Surya’s position. The Senior Advocate maintained that the post did not qualify as an offence under Section 505(2) of the Indian Penal Code (IPC), which addresses the promotion of enmity. The state government opposed the petition, suggesting that such posts could potentially harm societal harmony. Justice Nagaprasanna, however, questioned whether the registration of the FIR was justified, remarking that every action has an equal and opposite reaction.
