Bengaluru, Aug 29 (Reporter) The Karnataka High Court on Thursday dismissed petitions challenging the state's Congress government's decision to withdraw its consent for a Central Bureau of Investigation (CBI) probe into the alleged corruption and disproportionate assets of Deputy Chief Minister DK Shivakumar.
The division bench of Justices K Somashekhar and Umesh Adiga dismissed the writ petitions of CBI and BJP MLA Basangouda Patil Yatnal as "not maintainable", saying the matter is better suited for resolution by the Supreme Court.
"The issue involves the Centre's authority to deploy the CBI in a state that has legally withdrawn its consent. Such a matter is better suited for resolution by the Supreme Court. Therefore, both writ petitions are dismissed as not maintainable," the court stated in its ruling.
The case has its roots in a decision made by the previous BJP government in Karnataka in September 2019, granting the CBI consent to investigate Shivakumar for alleged corruption and disproportionate assets.
Following the Congress party's victory in the May 2023 Assembly election, the new government, led by Chief Minister Siddaramaiah, revoked this consent on November 28, 2023. This move effectively halted the CBI's investigation and transferred the matter to the Karnataka Lokayukta.
The petitioners argued that the decision of the state government undermined the CBI's authority and was politically motivated. Shivakumar, a prominent Congress leader, was appointed as Deputy Chief Minister following his party's electoral victory.
Senior Advocates Kapil Sibal and Abhishek Manu Singhvi, representing Shivakumar, argued that the CBI's involvement in the case, based on the consent given by the previous BJP government, violated federal principles and was intended to harass Shivakumar.
