New Delhi, Jan 8 (Reporter) Lakshadweep MP Mohd Faizal on Monday filed a petition in the Supreme Court challenging the Kerala High Court order which had rejected his plea to drop charges against him in a case of attempt to murder resulting in his disqualification as the Lok Sabha MP for the second time this year.
Faizal represents Lakshadweep in Parliament as a member of the NCP party. He was disqualified as a member of the Lok Sabha on October 4, 2023, the very next day after the high court held him guilty on October 3
The Kerala High Court on October 3, 2023, had rejected the plea of Lakshadweep MP Mohammed Faizal to suspend his conviction in a 2009 murder attempt case. However, the court stated that the suspension of the sentence of Faizal and three others, as per its earlier order, would continue pending the final disposal of their appeal.
The bench of Justice N Nagaresh considered the matter after the Supreme Court on August 23 set aside the High Court's earlier order suspending his conviction and 10 years of imprisonment in a case for attempting to kill Mohammed Salih, son-in-law of the late Congress leader and former Union minister P M Sayeed, during the 2009 Lok Sabha polls. The apex had directed the high court to decide the matter afresh in six weeks.
Additional Solicitor General K M Natraj appearing for the Lakshadweep Administration suggested to the Supreme Court that the case of Mohd Faizal regarding the suspension of conviction and sentence can be disposed of like in the case of the Afzal Ansari Judgement in which the court in a 2:1 opinion suspended his(Ansari’s) conviction and let him be the member of Parliament subject to not having any salary, perks, voting rights in the house.
The Supreme Court Bench asked the counsel for Faizal to examine the judgment and come to the Supreme Court with instructions in two weeks...////...
