Maha: HC grants four weeks time to CM Shinde-led MP Waikar to file reply on election petition

Mumbai, Sep 2 (Reporter) The Bombay High Court on Monday granted four weeks' time to member of parliament Ravindra Waikar of Maharashtra of Chief Minister Eknath Shinde-led Shiv Sena to reply on an election petition filed by defeated Shiv Sena (UBT) candidate Amol Kirtikar, seeking cancellation of Waikar’s victory from the Mumbai North-West constituency in the recent Lok Sabha election. A single-judge bench of Justice Sandeep V Marne had issued a notice to Waikar on July 29. Senior Advocate Anil Sakhare, arguing for Waikar, today sought time to file a reply to Kirtikar's petition. While granting four weeks' time to Waikar to file a reply, the court has posted the matter for hearing on October three. Kirtikar had lost to Waikar by a slender margin of just 48 votes. While Waikar got 4,52,644 votes, Kirtikar garnered 4,52,596 votes. In his petition, Kirtikar urged the high court to set aside Waikar's election as the MP and to declare the same as "null and void". Kirtikar has further sought that he be declared as the duly elected candidate from the said constituency. His plea claims that he had sought recount of the votes on the counting day itself as there was discrepancy. The plea claims that there were various glaring and serious lapses on the part of the election officials deputed to carry out the counting process, which have resulted in the result of the election being materially affected. “The election petitioner (Kirtikar) is aggrieved on account of improper reception of void votes cast by 333 impersonators in place of genuine voters, along with breach of rules / orders, pertaining to the counting process, by ECI officials, which has materially affected the outcome of the election result,” the plea read. The returning officer showed "high-handed hastiness and palpable arbitrariness" at the time of the counting of votes, Kirtikar’s plea alleged. Kirtikar also sought the court to summon the video recordings of the entire counting process while hearing his plea. This is the second petition against Waikar's election, recently, a petition was filed agiang Waikar by Bharat Shah of the Hindu Samaj Party, also a candidate from the same constituency.
