Pune, Sep 2 (Reporter) In a significant and exceptional development in ongoing case involving Kadka Karan Singh and Abdul Hamid Jafri of Pune, a Magistrate court here has formally ordered to carry out a comprehensive reinvestigation pursuant to the protest petition filed by the Thadaney brothers, challenging the non-cognizable (NC) report submitted by the Bund Garden Police station, Pune before the court.
The order stipulates that the relevant authorities should undertake a thorough review and re-examination of the matter, in light of the contentions raised in the protest petition filed before the Judicial Magistrate First Class (JMFC) court in Pune.
The petition, submitted by Advocate Aashuutosh Srivastava, on behalf of the Thadaney family, seeks a
reinvestigation of FIR (first information report) registered at Bund Garden Police Station in August 2021.
The petition seeks to contest prior decision that emerged from the Investigating Officer's 'C' Summary Report which, submitted at the behest of Bundgarden Police Station, had recommended that no further action be taken regarding the matter under investigation.
In the petition filed by the Thadaney brothers, it is argued that the initial investigation was marred by substantial procedural shortcomings and oversights.
Consequently, the petitioners asserted that these deficiencies necessitated a thorough reevaluation and rectification to ensure justice is properly served, said Adv Srivastava on Monday.
The issue was initially referred to the Bombay High Court by the Thadaney brothers through their counsel Adv Srivastava, which had ordered for the submission of affidavit by the deputy commissioner of police regarding the detailed investigation into the case.
Upon realising that the NC Summary report was submitted before the JMFC Pune, the high court referred the matter to JMFC by giving liberty to the petitioners.
Thereafter, on approaching JMFC Pune, Judicial Magistrate First Class J Koinkar reviewed the said petition and after final arguments, the Magistrate vide order dated August 29 concluded that the initial investigation had indeed revealed lacunae.
Consequently, the local court rejected the NC Summary report and ordered a fresh investigation into the case...////...
