Mumbai, Aug 21 (Reporter) The Bombay high court on Wednesday asked city police to file a reply to a plea moved by Mihir Shah, the prime accused in the BMW hit-and-run incident, in which a 45-year-old fisherwoman Kaveri P Nakhwa was killed at Worli in south Mumbai last month.
Mihir Shah, through his lawyers, has sought his immediate release while claiming that his arrest is illegal.
Pending the hearing of his habeas corpus plea, filed on August 14, Shah in his plea before division bench of Justices Bharati H Dangre and Manjusha A Deshpande had claimed that the remand orders were passed without following due process.
On July seven, Shah allegedly rammed his luxury car into a two-wheeler in Mumbai's Worli area, killing Kaveri Nakhwa (45) and leaving her husband Pradeep injured.
His driver Bidawat, who was also present in the car at the time of the accident, was arrested on the same day, whereas Shah was arrested two days later. At present, both are in judicial custody...////...
