'No bar' to arrest absconding TMC leader Shahjahan Sheikh : Calcutta HC

Kolkata, Feb 26 (Reporter) The Calcutta High Court on Monday said there is 'no bar' in arresting the absconding TMC leader Sheikh Shahjahan, who is evading arrest since January 5. A Division bench comprising Chief Justice T S Sivagnanam and Justice Hiranmoy Bhattacharya during a hearing directed that a public notice be issued immediately in the newspapers by the High Court Registrar stating that Shahjahan Sheikh has been impleaded in the matter, as he is on the run and not seen in public since a mob attack on ED officials and CRPF jawans on January 5, 2024. On a prayer by a Court-appointed Amicus curiae for clarification on whether there is a restraining order on police from arresting Sheikh, the Division bench said there was no such stay and the police could arrest him. "Whatever claims (AITC general secretary) Abhishek Banerjee was making yesterday ( Sunday night) it has been rubbished by the Calcutta High Court where it has said that there is no such stay order that (TMC leader) Shahjahan Sheikh cannot be arrested. This has been very well clarified by the Chief Justice,” Advocate and BJP leader Priyanka Tibrewal told reporters outside the courtroom. On Sunday Abhishek Banerjee denied charges of protecting Shahjahan Sheikh and said that the hands of the state police were tied. He told reporters why "you did not question the Calcutta High Court why there is a bar to arrest Shahjahan Sheikh."? Two days ago state Irrigation Minister Partha Bhowmick and Fire Brigade Minister Sujit Bose while interacting with the agitating women at Sandeshkhali had also said that there was a bar by the court to arrest Shahjahan. The Division bench of the High Court also directed that Shahjahan, Enforcement Directorate (ED), Central Bureau of Investigation (CBI)and West Bengal Home Secretary be impleaded as parties in the matter. Meanwhile, the District and Sessions Court of Barasat today said that an anticipatory bail petition moved on behalf of the TMC absconding leader will be heard on March 15. An FIR was lodged with the Nazat police station against Sahjahan Sheikh, who is accused of leading his followers and some TMC leaders to grab the land of the poor tribal people and convert them into fish farming and sexually harassing the women...////...
