Pune car accident case: HC orders to relase juvenile accused from observation home

Mumbai, Jun 25 (Reporter) The Bombay High Court on Tuesday ordered the release of juvenile, an accused in the Pune car accident case, from the observation home popularly known as remand home. The court passed an order on a plea by the aunt of the juvenile, seeking immediate release of the accused in the May 19 fatal car accident case in Pune, in which two IT professionals were killed. A division bench of Justices Bharati Dangre and Manjusha Deshpande ordered the release of the teenager and into the care and custody of his paternal aunt. The court has also directed that the boy's sessions with the psychologist should continue. "We allow the petition and order his release. The CCL (Child in Conflict with Law) shall be in the care and custody of the petitioner (paternal aunt)," the court said. The bench noted the Juvenile Justice Board (JJB)'s remand orders were illegal and passed without jurisdiction. Earlier, the Bombay HC on June 14 had refused to grant urgent relief on a plea filed by aunt of the teenager, alleging that he was in "illegal" detention and sought his immediate release. The habeas corpus (produce person in court) petition filed by the boy’s paternal aunt sought immediate release of the 17-year-old boy, who is currently lodged at an observation home in Pune.
