Patna, Nov 26 (Reporter) The reservation and its 65 percent limit issue rocked Bihar Assembly which witnessed a vociferous exchanges between the opposition and the Treasury benches following which the visibly annoyed opposition staged walkout from the lower house during the pre-lunch sitting on Tuesday.
Soon after the Speaker Nand Kishor Yadav turned down the adjournment motions, the opposition leader Tejaswi Prasad Yadav raising the issue tried to take the credit of the increase in the reservation limits based on the caste survey in Bihar when he was the Deputy Chief Minister in the grand alliance government led by the Chief Minister Nitish Kumar.
In support of his points, Yadav started outlining various events which later resulted into a vociferous exchange between the opposition and the treasury branches including the present Deputy Chief Ministers Samrat Chaudhary and Vijay Kumar Sinha.
When Yadav said that it was the grand alliance government which raised the reservation limits to 65% for the OBC, EBC, SC and ST, Samrat Chaudhary contradicted it saying that people have not forgotten the 15 years rule of Lalu-Rabri, parents of Yadav who did not accord even a single reservation to the section during their regime.
Chaudhary said that it was the NDA government which gave reservation and now every class was enjoying the facility.
Annoyed with it, the entire opposition walked out of the house.
Earlier speaking on the issue, the Oppositon leader said that the reservation limit for OBC, EBC, SC and ST which was extended up to 65% was implemented in the state on November 19, 2023 when he was in power in the grand alliance government.
In addition to the 65% reservation, the 10% reservation for the economically weaker sections continued, he said adding the Patna High Court describing the caste survey as study conducted not properly dismissed the 65% reservation limit on June 30, 2024.
For thism he blamed BJP saying that the people associated with the party had gone to the court against the extension of the reservation limit to 65%.
To this, the Deputy Chief Minister Vijay Kumar Sinha said that giving any statement about any political party without evidence was wrong and against the constitution. He also accused Yadav, leading the opposition party for acting against the constitution.
Another Deputy Chief Minister Samrat Choudhary, visibly angry, said that it was Nitish Kumar who led the government when the reservation limit was extended and implemented.
Intervening into the situation, Speaker Nand Kishore Yadav appealed to the members to share their views in proper manner.
The leader of opposition further said that the people of Bihar were facing 16% loss in the reservation and maintained that it was his government which had conducted the survey and implemented the extended limits of reservation within a short span of 17 months of the rule.
Yadav demanded constitution of a committee of the state assembly to study the issue and asked to increase the reservation limit up to 85% through an amendment by the cabinet which he said can be passed through the state legislature for which he requested to extend the sittings of the ongoing session of the state legislature for a day or two.
Intervening, Parliamentary Affairs Minister Vijay Kumar Chaudhary giving credit to all political parties and leaders cutting across party lines for increase in the reservation limits said that its basic concept was however of the Chief Minister Nitish Kumar and when he took the decision for the first time the NDA was in the power in the state.
Later, Kumar was with the grand alliance government and the present opposition party which was with him in the government also supported him in the mission at that time but at the time of increase in the reservation limit and its implementation the NDA was in power with Kumar heading the government.
Chaudhary maintained that from beginning till end related to the entire process of increase and implementation of the reservation limits, the Government in Bihar was of the NDA.
Highlighting the historical facts related to the first ever amendment in the Indian Constitution for inclusion of the 9th schedule in the constitution to protect the laws related to social reforms, Chaudhary said that all parties had agreed for inclusion of the new law of the reservation in the 9th schedule to protect it from any legal revision, however some people moved to the court and the law was rejected.
The Minister said that currently no such law was in existence and the appointments were being made according to the old reservation facilities as per the order of the court.
Chaudhary requested all the political parties and the leaders to help in the related matter presently in the supreme court as they all were of the same view point on the issue.
Tejaswi Yadav, however asked the government to explain why it was not included in the 9th schedule for the seven months after its passage.
To this the Deputy Chief Minister Samrat Chaudhary blamed Yadav for manipulating the court by creating confusion on the issue and reminded him that no reservation was accorded by his parents when they were in power in Bihar. He said the reservation was given in 2006 only when Nitish Kumar came into power in 2005.
Visibly annoyed, the opposition walked out from the house...////...
