Patna, Aug 2 (Reporter) Leader of opposition in Bihar assembly Tejaswi Prasad Yadav announced to file a petition before the supreme court on Monday on the issue of 65 per cent reservation.
Yadav told newspersons here on Friday that the party would move the apex court and would also launch a massive tirade against the procrastinating attitude of the state government on the issue.
Yadav said he wished the reservation arrangements to be executed in Bihar on the pattern of Tamilnadu and be included in the 9th schedule to prevent any kind of challenge before the Judiciary but the BJP since the beginning was obstructing it.
Training his guns towards Chief Minister Nitish Kumar and his cabinet colleagues belonging to the JDU for their silence on the matter, Yadav alleged that Kumar had miserably failed and flopped on the issue.
He also challenged Kumar to topple the government if he cannot do anything even after being a major part of the government on such an important issue. He asked Kumar to explain his position in the NDA government and suggested he snap his ties with the BJP government.
He said RJD would not give up the issue and would continue his movement for including the reservation amendment of Bihar in the schedule of the Indian Constitution.
Expressing dissatisfaction over the Supreme Court's verdict on the issue of reservation, especially regarding the SC ST and their classification, Yadav pleaded for providing jobs to everyone to bring economic equality. He asked the central government to remove the economic disparity through the bill.
The RJD leader said that the oppressed receptions are still facing exploitation and the creamy layer issue cannot be considered among the oppressed tribals.
Objecting to the Supreme Court's verdict for the execution of the creamy layer and fixing the quota within the reservation quota for SSC ST, he said the creamy layer cannot be executed in this class.
He said Baba Sahab Bheemrao Ambedkar made the provision of reservation in the constitution only to cover up the social disparities, untouchability and other discriminations.
Dubbing BJP and JDU as anti-reservation, Yadav alleged that the centre shed its responsibilities by including the reservation amendments of Bihar in the 9th schedule of the constitution.
Yadav said the Grand Alliance government had increased the reservation limits to 65
per cent and a related proposal for including it in the 9th schedule was sent to the centre with the consent of the Council of Ministers of Bihar.
He said, in a reply to a related query of RJD MP Manoj Jha in the Rajya Sabha the union government tried to shed its responsibility by taking a wrong plea that the matter falls under the purview of the state government as per the provisions of the constitution.
In a landmark judgement, a seven-judge Bench of the Supreme Court on Thursday said that the "Creamy Layer" must be excluded from Scheduled Castes/Scheduled Tribes from reservations and a policy must be evolved by the State to identify the creamy layer among the SCs/STs.
Meanwhile, BJP state President and Bihar Minister Dilip Jayaswal reacting sharply at the announcement of Yadav launching a tirade in favour of 65percent reservation, said that the Lalu family had no right to speak on the issue as remaining in power Lalu Rabri did not initiate for increasing the reservation limit...////...
