SC declines to interfere with HC decision in Dabholkar murder case

New Delhi, Jan 8 (Reporter) The Supreme Court on Monday declined to interfere with the Bombay High Court order that refused to continue a court-monitored probe into the 2013 Dabholkar Murder Case. A bench Comprising Justice Vikram Nath and Justice Satish Chandra Sharma refused to interfere with the Bombay High Court order by which it had discontinued the court-monitored probe into the murder of Physician and activist Narender Dabholkar in 2013. The Supreme Court said "We Leave it open for the petitioner to provide any material related to the criminal case to the CBI." The Bench said that monitoring by the court cannot be at the pleasure of a party and ruled that the high court order was reasonable. Senior Advocate Anand Grover, appearing for the petitioner, pleaded that the high court should continue to monitor the investigation as there is a larger conspiracy that needs to be unearthed. Grover said otherwise only those persons will be arrested who are shooting and not the mastermind. He further said that before the matter could be investigated, the high court said declined to monitor the investigation any more. The Supreme Court bench asked Grover who he thought was the mastermind. Grover replied, "We don't know, CBI has to investigate". The bench dismissed the petition saying, "You don't know, they don't know, prima facie, we are not inclined to interfere. the petition is dismissed. However, we leave it open for the petitioner to provide any such material which may come in handy and may be related to the criminal cases in question. The same be provided to CBI," the bench said. Dabholkar, the founder of the Maharashtra Andhashraddha Nirmoolan Samiti, was shot dead in August 2013, In 2014 CBI was handed over the investigation. The CBI submitted its chargesheet and also mentioned that Dabholkar’s murder was an ‘act of terrorism’. Dabholkar’s daughter challenged the high court’s order, wherein, the court said that further monitoring of the investigation by the Court was not required as chargesheet was filed and the trial had begun. Dabholkar’s daughter alleged that there was a larger conspiracy behind her father’s murder. The bench said that the court was not inclined to interfere prima facie and dismissed the petition...////...
